1. Definitions

  1. Website
    https://MegaShop.h24d7.com

  2. User / You
    Any natural person using or accessing the Website.

  3. Consumer
    A natural person acting for purposes outside their trade, business or profession.

  4. Services
    All goods (physical or digital) and ancillary services offered via the Website.

  5. B2P
    “Browse to Purchase” model—direct purchase through the Website.

2. Scope & Applicability

These ToS govern all contracts between MegaShop.H24D7.com and Consumers. Any special conditions for subscriptions, gift cards or digital content will be presented at purchase.

3. Contract Formation

  1. Product listings are non-binding invitations to order.

  2. Clicking “Order” constitutes a binding purchase offer.

  3. We confirm receipt immediately via e-mail (Order Confirmation). The contract is concluded when we send shipment confirmation or deliver digital content.

4. Right of Withdrawal (14-Day Cancellation)

Consumers may withdraw from distance contracts for physical goods within 14 calendar days without giving reasons.

  • Withdrawal period begins when you, or your designated recipient, take physical possession of the goods.

  • To exercise, notify us by e-mail (service@h24d7.com) before the period expires. You may use the model withdrawal form in Annex I (not obligatory).

  • Effects: We refund all payments (including standard delivery) within 14 days of your notice. We may delay refund until we receive the goods back or proof of return. You bear return shipping costs.

Exceptions: No right of withdrawal for:

  • Custom-made or personalized items;

  • Sealed hygiene products unsealed after delivery;

  • Goods mixed inseparably with other items after delivery.

5. Prices, Taxes & Payment

  1. All prices include applicable VAT and fees.

  2. Shipping, import duties or local taxes displayed at checkout.

  3. Payment methods: SEPA direct debit, Crypto and those shown at checkout.

  4. Payment is due immediately upon ordering. We reserve the right to refuse certain methods.

6. Delivery & Performance

  1. Delivery times/costs shown at checkout.

  2. We use reputable carriers—delays by third parties (e.g. customs) are beyond our liability.

  3. Risk transfers to you once you (or your designated recipient) take possession.

7. Retention of Title

We retain title to goods until full payment of all our claims under the contract.

8. Digital Content & Services

  1. For digital goods (e-books, downloads, streaming), performance is complete once you begin download or streaming.

  2. By consenting to immediate delivery, you acknowledge waiver of withdrawal rights per EU Consumer Rights Directive Art. 16(2)(c).

9. Warranty & Liability

  1. We are liable for defects in accordance with mandatory statutory law.

  2. For used goods, liability is limited to one year unless otherwise agreed.

  3. Liability for slight negligence is limited to foreseeable, typical damages.

  4. Excluded: indirect damages, lost profits, third-party claims—except in cases of intent or gross negligence.

10. Consumer Dispute Resolution & ODR

We do not participate in consumer arbitration boards.

11. Privacy & Data Protection

We process personal data under the GDPR.

12. Cookies & Tracking

We use cookies to operate the Website, improve UX, and tailor offers.

13. Intellectual Property

All Website content (texts, images, logos, software) is protected by copyright and other IP laws. Unauthorized use is prohibited.

14. User Conduct

You agree not to:

  • Violate laws or third-party rights;

  • Disrupt Website operation or security;

  • Attempt unauthorized data access.

15. Force Majeure

Neither party is liable for delays or non-performance due to events beyond reasonable control (e.g. natural disasters, strikes, governmental acts).

16. Severability

If any provision is invalid or unenforceable, the remainder remains effective.

17. Assignment

You may not assign rights or obligations under these ToS without our written consent. We may freely assign.

18. Changes to Terms

We may update these ToS (e.g. to reflect legal changes). Updated versions take effect upon posting; continued use constitutes acceptance.

19. Governing Law & Jurisdiction

German law applies (excluding conflict-of-laws rules). Consumers retain any mandatory statutory protections (e.g. local jurisdiction). Otherwise, Berlin courts have exclusive jurisdiction.
